Terms of Service

Welcome to the Appletastic Club, the teacher membership site at AppletasticClub.com, run by Appletastic Learning, Inc. (“Appletastic Learning,” “we,” “us”). These Terms of Service (“Terms”) are the agreement between you and Appletastic Learning for your use of the site and your membership. By creating an account, buying a membership, or using the site, you agree to these Terms and to our Privacy Policy. If you don’t agree, please don’t use the site.

1. Who can join

The Club is for teachers, homeschool parents, tutors, and other educators. You must be at least 18 years old to create an account or buy a membership. The site and its resources are made for adults to use with their students; it is not designed for children to use on their own.

2. Your account

Keep your login details private. You are responsible for everything that happens under your account, so please tell us right away if you think someone else has used it.

One membership is for one teacher. Your login may not be shared with colleagues, a grade-level team, or your school. If several teachers want access, each needs their own membership. For school or district pricing, see our Purchase Orders page or email us at [email protected].

3. Memberships, billing, and renewals

We currently offer three memberships: the 4th Grade Appletastic Club, the 5th Grade Appletastic Club, and the All Access Appletastic Club (both clubs). Each is available as a monthly or an annual subscription. The price and billing period are shown at checkout. Prices are in US dollars; any applicable taxes are shown at checkout too.

Your membership renews automatically. At the end of each billing period (every month or every year, depending on the plan you chose) the card on file is charged for the next period at the current price for your plan, until you cancel. We email a receipt for every payment. If a payment fails, we may retry it and may pause your access until it goes through.

If we ever change the price of your plan, we will email you at least 30 days before the new price applies to you, so you can decide whether to stay.

Your first payment. You pay the full price for the plan you chose (monthly or annual) on the day you join, as shown at checkout, and your membership starts right away.

Payments are processed securely by our payment processor. We never see or store your full card number.

4. Cancelling and refunds

You can cancel anytime from your account page on AppletasticClub.com, or by emailing [email protected]. When you cancel, you keep access until the end of the billing period you have already paid for, and you will not be charged again.

Because the resources are digital and available the moment you join, payments are not refundable, and we do not give credits for unused time, including the remaining months of an annual plan.

5. Your license to use the resources

While your membership is active, we give you a personal, non-exclusive, non-transferable license to download, print, and use the resources in your membership to teach your own students - in your own classroom or homeschool, including on a password-protected class platform (such as Google Classroom, Seesaw, or Canvas) where only your own students can see them.

While you are a member you may not:

  • share, email, upload, or post the files, or links to them, anywhere other people can get to them - shared drives, school servers, Facebook groups, websites, or marketplaces;
  • sell, trade, or give away the resources or anything made from them;
  • use the resources to create products you sell or distribute;
  • remove copyright notices, our name, or our logo; or
  • use the resources for a business beyond your own teaching (for example a school, a grade level team, tutoring company, or learning center) - please email us about a license instead. Schools and districts can buy a license for each teacher on our Purchase Orders page.

After your membership ends you may keep using the resources you printed or downloaded while you were a member, for your own classroom. All of the sharing rules above still apply.

All resources, the site, and the Appletastic Learning and Appletastic Club names and logos belong to Appletastic Learning, Inc. and are protected by copyright and trademark law. All rights not granted in these Terms are reserved. If you believe something on the site infringes your rights, email us and we will look into it promptly.

6. Changes to the Club and to these Terms

We add, update, and sometimes retire resources. We cannot promise that any one resource will always be available, but our aim is always to make the Club more useful to you, not less.

We may update these Terms from time to time. When we do, we will post the new version here and update the effective date, and for any significant change we will email you. Continuing to use the Club after a change means you accept the updated Terms.

7. Ending a membership for misuse

We may suspend or end a membership, without a refund, if the login is shared, resources are redistributed, or these Terms are otherwise broken. Unless the problem is serious, we will email you first and give you a chance to make it right.

8. Emails from us

We will email you about your account, your payments, and important changes to the Club - those emails are part of the service. We may also send tips, new-resource announcements, and offers; you can unsubscribe from those at any time using the link in the email.

9. Disclaimers

The resources are provided “as is.” They are created by an experienced teacher, but we do not guarantee that they meet any particular standard, curriculum, or outcome, and they are not a substitute for your own professional judgment about what is right for your students. We are not responsible for interruptions to the site caused by our hosting provider, your internet connection, or events outside our control.

10. Limit on our liability

To the fullest extent the law allows, Appletastic Learning, Inc. is not liable for indirect, incidental, special, or consequential damages, and our total liability for anything related to your membership or the site is limited to the amount you paid us in the 12 months before the claim.

11. Governing law and disputes

These Terms are governed by the laws of the State of Wyoming, without regard to its conflict-of-law rules. If we ever disagree about something, we would much rather talk first. Please email us and we will do our best to sort it out. Any dispute that cannot be resolved informally will be handled in the state or federal courts located in Sheridan County, Wyoming.

12. A few legal odds and ends

These Terms, together with the Privacy Policy, are the whole agreement between you and us about the Club. If any part of these Terms turns out to be unenforceable, the rest still applies. You may not transfer your membership or this agreement to anyone else. If we do not enforce a part of these Terms right away, we are not giving up the right to enforce it later.
